General Terms and Conditions

1) Sale

All offers submitted are subject to change. The prices quoted are net prices plus VAT and are ex works. The minimum order value is £150.00, below which a minimum quantity surcharge of £5.00 applies. We accept no liability for any typing errors in our offers. By placing an order, the customer agrees to my terms and conditions of sale and delivery. Any conflicting terms and conditions of the customer require my written confirmation to be valid. The terms and conditions apply to all transactions with the customer without the need for repeated reference.

2) Delivery

I reserve the right to deliver up to 10% more or less than the ordered quantity for custom-made products. Delivery times can only be given as approximate. Penalties for delay or other claims for damages are excluded. All cases of force majeure release me from the delivery obligation and give me the right to withdraw from the contract in whole or in part. Orders for custom-made products cannot be returned. Cancellation is only possible in exceptional cases if the customer reimburses the costs incurred in full. We reserve the right to make partial deliveries.

3) Complaints

Objections to the quantity or quality of the goods can only be considered if the complaint is received within 8 days of receipt of the goods. Even if the complaint is made in good time, claims for damages are excluded.

4) Retention of title

I reserve the right of ownership for all goods delivered by me until full payment has been made. In the event of breach of contract by the customer, in particular in the event of default in payment, we shall be entitled to take back the goods after issuing a reminder and the customer shall be obliged to surrender them. The assertion of retention of title and the seizure of the delivery items by us shall not be deemed a withdrawal from the contract unless expressly stated by us in writing. If the customer resells the delivery items, the proceeds from the sale shall be deemed assigned to us in advance in the amount of the purchase price agreed between us and the customer.

5) Terms of payment

My invoices are payable within 10 days with a 2% discount or within 30 days without discount. If the payment period of 30 days is exceeded, default interest of 5 % above the basic interest rate will be charged in accordance with § 288 of the German Civil Code (BGB).

6) Packaging costs

Packaging is invoiced at cost price and cannot be returned.

7) Dispatch

Shipping is at the purchaser's risk, whether free of charge or not. Prices are generally quoted ex works. We reserve the right to choose the most economical means of transport.

8) Competent jurisdiction

The place of performance is Schonach and the place of jurisdiction in all cases is Villingen-Schwenningen. German law shall apply exclusively, to the exclusion of the laws on the international purchase of movable property, even if the purchaser is based abroad.

9) Other

Changes to these terms and conditions shall only be valid if they are made in writing. Should individual provisions be or become invalid, this shall not affect the validity of the remaining provisions. My images, PDF catalogues and the user data of the website www.erwin-pfaff.de may not be reproduced or made available to third parties without my written permission. In the event of non-compliance, the damage caused will be invoiced to the responsible party.
